Terms and Conditions

Introduction

These Terms apply to your online purchase of tickets and concessions (including but not limited to 3D glasses, food and drink) from Book the Cinema platform using the Book the Cinema website. They contain important information about your purchase, so please read carefully. From the point at which you make your Order, we act solely as an intermediary between you and the Cinema, transmitting the relevant details of your Order to the relevant Cinema(s) and sending you a confirmation email and invoice for and on behalf of the Cinema. Book the Cinema is acting solely as booking agent for the Cinema when it is selling tickets or concessions on behalf of the Cinema.

When rendering our booking service, the information that we disclose is based on the information provided to us by Cinemas. As such, the Cinemas that market and promote their Screens on our Platform are given access to our systems and extranet through which they are fully responsible for updating all rates/fees/prices, availability, policies & conditions and other relevant information which is displayed on our Platform. Although we will use reasonable skill and care in performing our booking service, we will not verify if, and cannot guarantee that, all information is accurate, complete or correct, nor can we be held responsible for any errors (including manifest and typographical errors), any interruptions (whether due to any (temporary and/or partial) breakdown, repair, upgrade or maintenance of our Platform or otherwise), inaccurate, misleading or untrue information or non-delivery of information. Each Cinema remains responsible at all times for the accuracy, completeness and correctness of the (descriptive) information (including the rates/fees/prices, policies & conditions and availability) displayed on our Platform. Our Platform does not constitute and should not be regarded as a recommendation or endorsement of the quality or service level of any Cinema made available, save as explicitly indicated or set out otherwise.

About Us

In these Terms, if you are in the UK, “Unique” means Unique Digital Software Limited, a company registered in England with company number 08811570. You can find our registered office and VAT number on the main page on the website / by contacting us.

If you have any questions regarding these Terms or your online purchase, please contact us via the "Contact Us" page of the website.

Your purchase

Your online order is an offer to purchase. If Book the Cinema accepts your order, we will display a confirmation page on your screen, and there will be a contract between you and Unique / Book the Cinema should you purchase any concessions provided by Unique / Book the Cinema. You will also enter into a contract between you and the Cinema for the purchase of your tickets and any concessions provided by the Cinema. We will e-mail you a confirmation of your order and an invoice.

If an online pricing error occurs, and the error could reasonably be recognised by you as an error, Unique / Book the Cinema is not obliged to supply at the incorrect price, even after the confirmation page has been displayed and the confirmation email has been sent to you.

Price and availability information is subject to change without notice.

All prices include VAT.

Your ticket purchase

Age restrictions apply to film viewing and some ticket types. Please check carefully before you book and be ready to show proof of age at the cinema.

You need 3D glasses to watch a 3D film. You can buy these when you book your ticket and collect at the Cinema/at the Cinema if you don't already have a pair. 3D glasses are provided by the Cinema in the event of booking an Imax film, please see the Cinema's terms and conditions for full details.

Seating will be reserved unless the booking process states otherwise.

You can access your ticket in these ways:

  • At some cinemas, you can use the booking reference provided in your booking confirmation to collect your ticket.
  • A worldwide, non-exclusive, royalty-free, transferable licence to allow third parties to use the content for their purposes.At other cinemas, if you have booked on the [Unique / Book the Cinema website there will be a link to your ticket from your booking confirmation email. You can use the ticket to head straight to the screen. You can also share your ticket with friends and family so that they can go into the screen separately.

Prohibition on resale of tickets

The sale, resale or transfer of any ticket to a third party is expressly prohibited. Any resale or transfer (or attempted resale or transfer) of a ticket in breach of the applicable law or these terms and conditions are grounds for seizure or cancellation of that Ticket.

No other offers

No other offers can be used in conjunction with the booking of tickets via the Book the Cinema platform.

Your online concessions purchase

You can order food and drink online to be brought to your seat or collected in the Cinema. How this works depends on which cinema you select, as confirmed in the online purchase journey.

You can also add more food and drink items to your order after you have made your initial order, you can do this up to ninety-six (96) hours before the advertised start time of the screen. If you order using the Unique / Book the Cinema website you need to buy a film ticket to purchase food and drink online.

Once you have purchased your food and drink online, the Cinema will arrange for your purchased concessions to be available for collection from the screen on your arrival.

If you have purchased food and drink as a part of your booking they must be collected on the same day as your film screening, any time before the cinema closes.

Alcohol can only be purchased online at certain cinemas. Alcohol can only be ordered and consumed by people aged 18 or over. Our cinema partners will operate Challenge 25. If you appear to be under the age of 25 when collecting or receiving an online alcohol order, the cinema will only supply the alcohol if you show photographic proof of age.

Your right to cancel

For online ticket and food and drink purchases, there is no statutory cooling off right.

If you have booked tickets using the Unique / Book the Cinema website, you can cancel your order and refund all the items in the order up to seven (7) days before the advertised start time of the screening.

We will use reasonable endeavours to offer self-serve refund functionality on the Unique / Book the Cinema website but it may be unavailable for reasons beyond our control, or we may decide to suspend this functionality. In some cases there may be a small delay in activating the refund –if you get an error message please wait and try again a little later.

Please check your online order and ensure you meet the film and ticket type requirements (eg age) before you place your order, as we are under no obligation to refund or amend your purchase if you make a mistake or change your mind except as stated above.

Problems completing your order

We aim to honour all online food and drink orders but there may be times where your chosen items are not available on the day for reasons beyond our reasonable control. If this happens, you can choose whether to take a substitute product (up to a value of the food and drink you purchased) or receive a refund.

On occasions, cinemas may be shut or shut screens, or food and drink facilities temporarily for reasonable periods of time to carry out maintenance, repairs, refurbishment or cleaning, or where required by law, or for other reasons outside of our control. The cinemas will endeavour to reopen the affected facilities as soon as is reasonably possible in these circumstances. If the Cinema is required to cancel or amend your booking, we will endeavour to contact you to cancel, reschedule or refund your booking.

Refunds

Tickets are subject to availability and are generally non-refundable. We are under no obligation to refund you or exchange your ticket(s) in the event that you make any error when purchasing your tickets through the Site (including but not limited to selecting the wrong film or the wrong number of tickets), if you are excluded from viewing the film for any breach of these Ticket Terms or the Guest Admission Policy of the Cinema, or if your ticket is lost, stolen or damaged. However, we may, entirely at our discretion, refund you or exchange your ticket(s) in any of the situations mentioned above or where there has been any customer service issue that we consider warrants a full or partial refund or other offer of goodwill from us. Please note that, unless otherwise specified, any such refund will exclude any additional amounts paid for other items such as food and drink, merchandise or 3D glasses. Refunds will be made to the same payment card used to make the booking.

Your behaviour

The cinema general admission terms apply to everyone visiting the booked cinemas and the cinema reserves the right to refuse admission should you breach any of the cinemas general admission terms or these Terms. Our Privacy Policy sets out how [Unique] may collect and use your personal information when purchasing online from [Unique / Book the Cinema], and the choices you can make about how your personal information is used.

 

By using our site to purchase tickets you will provide us with certain personal and payment information.

We use your data to provide and improve our products and services, including for marketing, research, feedback and enquiries, and for safety and security purposes. We will use your data to comply with laws and regulations. We may use your data to prevent and detect crime, such as fraud.

You have the right to object to some of the processing Unique / Book the Cinema carries out. More information about your rights and how to exercise these is set out in the Privacy Policy

Your personalised content

Book the Cinema allows customers to upload and store digital photographic images (each an “Image”), and to access those Images through the platform – this is your “Image Storage”.

It is the responsibility of customers to have sufficient internet and device usage skills to make use of our platform.

Your Image Storage on the platform must not be used as your main or back-up storage facility for your Images. It is up to customers to make sure that their Images are securely stored elsewhere, as we do not guarantee that we will continue to make Image Storage available to you.

[Although we incur a cost in providing you with Image Storage, we do not charge for providing. However, we only provide Image Storage for customers who make a booking and select the personalised products. Image Storage shall only be available until the end of the event for which your booking is made.

We provide Image Storage at no cost principally in order to facilitate the creation and purchase of personalised images and videos bearing their Images to be screened at the Cinema during the booking. Accordingly, we do not intend or invite customers to store their Images other than for those purposes.

Your Image Storage must comply with our reasonable fair use requirements and those fair use requirements would be breached by, for example the automated or scripted uploading of Images or other content; the uploading of Images or other content on a high-frequency basis; or the inclusion of very large volumes of Images or other content in an individual album. A maximum of twelve (12) Images and/or one (1) video comprising a total of sixty (60) seconds may be uploaded. Should you breach our fair use requirements, we may cease to provide you with Image Storage and/or delete your Images and other content from our platform.

In the course of storing your Images, we reserve the right to apply various techniques to make generally accepted improvements to the quality of the Image, such as by:

  • the removal of “red-eye”;
  • brightness enhancement; and
  • detail enhancement

We also reserve the right to make changes to Images which are intended to improve their storability, including:

  • Compression;
  • Size reduction and downscaling; and
  • Format conversion.

We strive to retain Images that are of sufficient quality for inclusion in personalised packages, but some loss and modification of detail may be apparent under close examination. We use reasonable commercial endeavours in our provision of Image Storage, but do not provide any guarantees as to the availability, speed of access to or reliability of the storage we provide and we do not provide you with access to those Images once they are uploaded to the platform.

Our policies concerning the storage of Images and content may change from time to time.

If an Image does not meet our specifications you may not be able to upload it and/or you may find that it is not possible to use that Image in conjunction with some or all of our packages.

We have rules about Images, and these apply to the content of Images (“Content Rules”); if you breach our Content Rules, we may – among other things – delete your images and cancel your personalisation package. If your personalised package is terminated, we may delete all Images associated with that personalised package, so that they will no longer be accessible.

If we are notified of a claim or allegation that an Image breaches our Content Rules, we may prevent that Image being accessible through the platform or being used in connection with personalised packages.

As indicated, you should make sure that your Images are securely stored elsewhere, as we do not undertake or guarantee to keep your Images and other content indefinitely, and we will not be responsible for the loss of, deletion or corruption of Images or any content. We do not keep back-up copies of Images and other content; we have no liability to you or any customer if Images or other content becomes lost or corrupted as a result of any cause (including human error, software or hardware failure, failures of telecommunications or internet services, or events beyond our control).

For the avoidance of doubt, we are not providing an Image Storage service and we are only storing your Images for the purpose of providing the personalised packages and once your Images are uploaded to the platform we are no under obligation to provide access to the Images once they are uploaded. We will however provide the personalised package during the screening at the Cinema.

Images and other material (including textual annotations to and comments on Images) uploaded, posted, contributed, distributed, communicated, transmitted or linked-to by a customer on, through or in connection with the platform are treated as "User Content" for the purposes of these Terms. Customers must have the right to deal, and the right to authorise us to deal, with their User Content in the ways that they and we use it in connection with the personalised packages or for other purposes referred to in these Terms. You must not upload User Content, or otherwise deal with User Content through Book the Cinema, if you do not have the right to do so. Each customer shall ensure that his/her User Content, and his/her and our use of it, does not:

  • infringe anyone’s copyright; in particular, you must ensure that you either own the copyright in an Image that you upload to Book the Cinema or that you are fully licensed by the copyright owner to upload the Image and to make any subsequent use of it (such as by including the Image in a personalised package) or in email and postal communications we send to you);
  • infringe anyone’s privacy or data protection rights; in particular, you must ensure you have the right to depict any person who appears in an Image that you upload to Book the Cinema and to authorise the subsequent use of it (such as by including a depiction of that person in a personalised product or in email and postal communications we send to you);
  • infringe any other rights, such as a trade mark, of any person or entity or a duty owed to any person or entity, such as a duty of confidentiality;
  • contravene any applicable law (including, without limitation, any criminal law) or regulation;
  • include anything that is false, inaccurate, misleading, offensive, abusive, threatening or defamatory, or that might cause needless annoyance, inconvenience or distress to any person;
  • contain any computer virus, macro virus, Trojan horse, worm, or anything else designed to interfere with, interrupt, or disrupt the normal operating procedures of a computer or to surreptitiously intercept, access without authority, or expropriate any system, data or personal information;
  • misrepresent the customer's identity in any way or impersonate any person;
  • include any material containing personally identifying information about another person, such as their real name, address, phone number, or email address, except with the written approval of that person;
  • contain material which is pornographic, obscene, indecent or offensive, which promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age, or that may incite hatred or violence against any person or group;
  • harass, upset, embarrass, alarm or annoy any person;
  • give the impression that it emanates from us, if this is not the case;
  • advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse; or
  • infringe our fair use requirements (see above clause) or otherwise interfere with the proper working of Book the Cinema.

The above bullet points are our Content Rules.

Although we prohibit the uploading of Images and other content which infringes our Content Rules, we cannot control and do not monitor or pre-screen the use of our platform and website. It is possible that Images or other content may be accessible through our platform and site which contravenes our Content Rules. We are not responsible for such Images or content, but if you become aware of any such Images or content on our platform or site please contact us here.

We may without notice delete any Image or other content which appears to breach our Content Rules, or prevent any use of Services (including purchase of personalised packages) which includes any such Image or content. It shall be at our sole discretion as to whether any Images or other content is in breach of our Content Rules or other standards and if so we shall have the right to remove such content.

Following completion of your booking and screening at the Cinema we shall be under no responsibility to keep and/or return any User Content. We shall keep User Content until after the conclusion of the event for which your booking is made. After such date User Content will be deleted from our systems.

You must ensure that you comply with the laws that apply to you and your use of Book the Cinema, including as to User Content, the Images that may be viewed and the personalised packages that may be bought through Book the Cinema. That use may be prohibited or restricted in various jurisdictions.

Grant of Licence over User Content

By uploading, posting, contributing, distributing, communicating or transmitting User Content (including Images), a customer expressly grants to us a non-exclusive, royalty-free, irrevocable licence (including the right to grant sub-licences through multiple tiers) to use, reproduce, adapt, distribute and communicate to the public that User Content worldwide through Book the Cinema and any other interactive services through which Book the Cinema (or a service based on Book the Cinema) is accessible for the purpose of, performing obligations we owe to customers and exercising rights customers grant to us, subject to and in accordance with under these Terms. The licence under this Clause will survive any termination of these Terms or any cancellation, suspension or lapse of the relevant booking. For the avoidance of doubt, the licence under this Clause does not permit us commercially to exploit a customer’s Images (or other User Content) by creating and selling our own products bearing the customer’s Images (or other User Content) without the customer’s consent. Note that we may modify User Content in order to conform it to the requirements of a personalised package (such as by cropping Images).

If anyone contacts us in relation to User Content or a transaction associated with you, then you agree:

  • to provide all reasonable information and assistance we may require in connection with responding to that contact; and
  • to respond promptly and accurately to it, should we pass the message to you for a response.

Your responsibility to verify your age

It shall be your responsibility to verify the age of yourself and all those in your party upon arrival at the Cinema should you book to see a film with an age restriction and Cinema staff deem that age verification is required.

Liability

Nothing in these Ticket Terms affects your rights under the law or excludes or limits our liability for fraud or for death or personal injury resulting from our negligence. In all other circumstances, our liability to you shall be limited to the price paid for your ticket.

We are not responsible for any loss or injury that occurs at a Cinema and any claim or action you may wish to bring should be brought against the Cinema directly. We use reasonable care and skill to provide personalised packages in accordance with our specifications but:

  • the Services are provided "as is" and “as available”;
  • we do not warrant that the Services will be uninterrupted or error-free; and
  • we cannot and do not guarantee that Book the Cinema or the personal packages will meet your requirements, including (without limitation) as to the availability or speed of delivery of any User Content placed on or made through Book the Cinema.

Your Liability

You will be liable to Unique, and potentially to other persons, where activity by you or through your User Content associated with you breaches these Terms.

Your security when using the services

You must not share your password and account details with anyone else.

You must let us know if you think there has been unauthorised use of your account and / or if your phone or card is stolen or goes missing. We will not be liable for others using your account or card details to place Orders if you have allowed other people to gain access to your account.

Intellectual Property Rights

Unless stated otherwise, the software required for our services or available at or used by our Platform and the intellectual property rights (including the copyrights) of the contents and information of and material on our Platform are owned by [Unique / Book the Cinema or its associated group entities] or by the applicable Cinema. [The intellectual property rights of the films are owned by the distributor or other such owner of the content.]

Unique / Book the Cinema exclusively retains ownership of all rights, title and interest in and to (all intellectual property rights of) (the look and feel (including infrastructure) of) the Platform on which the service is made available and you are not entitled to copy, scrape, (hyper-/deep)link to, publish, promote, market, integrate, utilize, combine or otherwise use the content (including any translations thereof and the guest reviews) or our brand without our express written permission. To the extent that you would (wholly or partly) use or combine our (translated) content or would otherwise own any intellectual property rights in the Platform or any (translated) content, you hereby assign, transfer and set over all such intellectual property rights to Unique / Book the Cinema. Any unlawful use or any of the aforementioned actions or behaviour will constitute a material infringement of our intellectual property rights (including copyright and database right).

Other Sites and links

The Platform may include links to other web sites or material which are beyond its control. We are not responsible for content on any site outside the Platform.

You may not however include links to or link to our Platform without our express written permission.

Amendments to these Terms & Conditions

Unique reserves the right to add to or amend these Terms from time to time. Amendments will take effect when posted on the Unique / Book the Cinema website. If you make an online purchase after any amendment to these Terms, the updated version of these Terms will apply.

Other important information

If we fail to comply with these Terms, or fail to use reasonable skill and care in providing tickets, 3D glasses, food and/or drink to you, we are responsible for loss or damage that you suffer which is a foreseeable result of our failure. Foreseeable loss or damage can be foreseeable in two ways: either it is obvious that it will happen, or if at the outset both you and us knew it might happen. We are not responsible for loss or damage which is not foreseeable.

We may assign, transfer or deal in any other way with our rights and obligations under these Terms to any party at any time without notice to you. You may not assign such rights and obligations.

This contract is between you and us. No other person shall have any rights to enforce any of its terms. Each paragraph of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

If we do not insist immediately that you do anything you are required to do under these Terms, or if we delay in taking steps against you in respect of breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.

Governing Law and Dispute Resolution

If you live in the UK, these Terms are governed by English law and you can bring legal proceedings in respect of your purchase in the English courts.

All information, including these Terms, will be supplied to you in English only, and we will only communicate with you during any contract between us using the English language.
